1. Introduction
At Smartos, we prioritize the security of our customers' and users' information. All software, applications, browsers, and services provided by us are linked to this Privacy Policy, and include all means of communication with individuals via correspondence or phone belonging to our services.
When customers register to use services on the Smartos platform, rest assured that we have comprehensively secured the information, ensuring that only you and authorized individuals are allowed to access your account information.
Because we respect your privacy, we feel it is important for you to know how we handle the information we receive. Therefore, this privacy policy aims to help you understand what information we collect and how we handle it. By using our browsers and products (Smartos PMS, Smartos Bespoke Solution, Smartos Booking), customers and users agree to the collection and use of personal information as described in this policy. At the same time, this privacy policy is strictly related to our Terms of Service.
2. Definitions
- "Smartos" (or "we", "our", "system"): Refers to Smartos - the software and services exclusively developed by Smartos, headquartered in Da Nang, Vietnam.
- "Customer", "User" (or "You", "Your"): Individuals or organizations that use our Smartos Services and software, directly involved in the Terms of Use and Privacy Policy.
- "Customer Data": Information, data, reports, addresses, and other documentary information of the customer in electronic form that the user stores on the system.
- "Personal Data": Any information relating to an identified or identifiable individual.
- "Admin User": The user with the highest permissions: to access, adjust, create, edit, and delete all information and data on the Smartos system. At the same time, the Admin user can access all Smartos features according to the agreed and signed service package.
- "Staff User": A user who only has access to certain features on the Smartos system as decentralized by the Admin User.
- "Customer Content": Any images, descriptive text, video, audio, or other media that the Customer updates on the system or uploads to the service.
3. Personal Information We Collect From You
We collect information to ensure we provide better services to all users, and it is collected through various sources.
3.1 Information provided by the user: We collect information such as: Full Name, Company Name, Business Unit, Address, Email, Phone Number, Contact Address, time of your visit, and other identifying information to serve the purpose of creating profiles and contacting for consultation. You can autonomously modify your account information at any time by changing it in the management section (Profile) on the system.
3.2 Information uploaded/entered by the customer: Customer or user information may include uploading images, videos or storing them in Customer Data. Smartos does not directly contact or use internal personal information that the Customer (e.g., the Rental Unit) actively stores from third parties (e.g., the Rental Unit's Customers). Each customer using the software is solely responsible for notifying and asking permission from their customers or related third parties regarding the security of data that the customer actively collects on the Smartos software.
3.3 Information collected automatically: When users or customers use our services, we may automatically store information from the customer's or user's device using some advanced software technologies (such as IP address, browser type, operating system).
4. How We Collect & Allocate Your Personal Information
We obtain your personal information from a wide variety of sources:
- You provide some information directly (when registering an account and filling out a contact form on the system).
- We automatically record some information when you interact with our platforms or services (using cookies).
- We receive some information from Third Parties (e.g., when you choose to authenticate login through linked social network accounts like Google/Facebook).
Your personal information sent to us through Smartos platforms and services will be used for the following purposes:
- Providing information, setting up platforms, services, and support upon your request.
- Measuring traffic, improving services, and preventing fraudulent behaviors.
- Sending emails notifying about promotional programs, featured events, new services, surveys, and accommodation advertisements that may interest you.
- Notifying you of server system changes, technical issues, or regulatory policies.
- Resolving related disputes, claims, or issues.
Cases of information disclosure: Except to provide services as specified in Article 4, Smartos will not provide, sell, rent, or lend any personal data to third parties. However, we may provide reports and disclose in the following cases:
- With your written consent/confirmation.
- When it is necessary to share with technical partner contractors (server providers, email/SMS service providers having confidentiality agreements with Smartos) to maintain the continuity of the system serving you.
- Under Legal requirements, orders from Courts or Competent State Authorities to prevent fraud, scams, or to protect national security and interests.
5. Cookies & IP Addresses
When you access the browser/application page or use our services, the system uses "cookies" - a piece of information data temporarily stored on your hard drive. We use Cookies to personalize and enhance your online operation experience (e.g., not needing to ask for your password on every new page load in the same login session).
Only the Smartos network platform can read these cookie files. After you actively log out or close the entire browser, this session cookie usually expires. You can change your device settings to refuse all cookies. However, if you choose to decline cookies, this may heavily impact some in-depth features and utility experiences on the Smartos platform.
6. Location Data
We may propose to store and use information about your actual geographical location if you grant access rights ("Location Data"). The purpose of collecting location data is to display and recommend rental spaces and services currently available nearest to your location, to bring an optimal search experience. Customers can allow access or change, deny this right at any time in the personal device settings (on Phone or Computer Browser).
7. Security Information
Smartos maintains and applies reasonable technical network security measures (firewalls, data encryption) to protect your information data warehouse from loss, sabotage, abuse, unauthorized access theft, or disclosure in accordance with international information technology standards.
8. Storage and Transfer of Personal Information
Customer's personal information will be used throughout the process of using the system, cooperation, and contract signing. After the service provision contract ends or the account is canceled, all data will be redundantly stored for a maximum of 30 days. After this period, the customer's cloud storage data will be automatically and completely deleted from the system, unless there are special reservation requirements from the authorities/State.
Smartos implements restricted access control to internal information storage centers. We only elevate data access rights for engineers and staff personnel who necessarily need to operate to complete testing, correct errors, and perform maintenance on the system.
Network Risk Disclaimer: Although we always try to create high-level protective firewalls for your personal data, no global network environment system is 100% absolutely safe. In cases of targeted hacker attacks from the outside bypassing current defense barriers, Smartos will strive to coordinate to thoroughly address and comply with procedures under the Vietnam Cybersecurity Law; uncertainties regarding data moving across user's own unencrypted connection points will be the customer's own responsibility. (The system requires you to absolutely secure the Login Password link - do not share it with others to avoid profiteering).
9. Your Rights
When using software and services provided by Smartos, you have full civil rights as follows:
- You have the right to access, extract, edit, update, or delete personal account information directly on the user interface of the System.
- You have the right to contact our administration board at support@smartos.space to request higher-level support changes (We will verify identity through the Email/phone number linked to your main account before adjusting data to secure asset safety).
- You have the right to complain, object, or withdraw consent to use data at any time in accordance with Vietnamese law.
10. Links to Third-Party Services
During the experience, our platform may display banners or contain hyperlinks pointing to third parties (such as external property management systems, map services, advertising partners). Smartos only provides display space, completely unintegrated nor participating in processing online booking transaction activities. If you actively access these links, please note that those platforms/websites will apply their own independent Privacy, Transaction, or Data Collection Policies that are completely beyond the control of Smartos. We bear no responsibility or legal obligation for privacy when you submit data on an offline platform.
11. Children's Policy
The real estate service information page is not designed for, nor does it intentionally collect, any direct personal information from children/minors under 13 years old. If you are a parent or legal guardian discovering that a child under your control has inadvertently provided personal information on the Smartos platform, please promptly contact and report to us, we will immediately take necessary actions to cancel this out-of-bounds data amount.
12. Policy Updates and Amendments
Smartos has the full right to make refinements, updates, and amendments to this Privacy Policy at certain stages to timely comply with the legal corridor of the State of Vietnam without the obligation to directly notify each individual (in minor changes). You can refer to the latest updated version at the Footer section on our platform. Your continued use of the services and access after having an amended announcement means that you fully agree and are satisfied with those updated supplementary changes. (In case of severe structural changes directly affecting the data core, we will try to use the centralized notification feature via "Email" if available).
